Terms of Service
These Terms of Service ("Terms") govern your access to and use of the website miaessenza.com (the "Site") and every purchase you make through it. The Site is operated by Mumora Media LLC, trading as Mia Essenza ("we", "us", "our"). By visiting the Site or placing an order you agree to these Terms. Please read them carefully together with our Shipping Policy, Refund and Exchange Policy, Payment Policy and Privacy Policy, which form part of these Terms.
1. Who can use the Site
By using the Site you confirm that you are at least the age of majority in your state of residence, or that you are the age of majority and have given consent for any minor dependants to use the Site. You may not use our products for any illegal or unauthorized purpose, and you may not violate any laws in your jurisdiction while using the Site. You agree not to transmit any malicious code or attempt to interfere with the operation of the Site.
2. Products and descriptions
We have made every effort to display the colors, textures and details of our products as accurately as possible. Screens differ, and we cannot guarantee that your monitor's display of any color will be exact. Product descriptions describe the visible design of each item; variant options such as size and color are shown on each product page. We reserve the right to limit the quantities of any products that we offer and to discontinue any product at any time. Any offer for a product made on the Site is void where prohibited.
3. Prices and payment
All prices are shown in US dollars (USD). Prices may change without notice, but changes do not affect orders that have already been confirmed. Shipping within the United States is free on every order. Any applicable sales tax is calculated and shown at checkout before you confirm the order. Accepted payment methods are those displayed at checkout and described in our Payment Policy. Payment is captured when the order is placed. We reserve the right to refuse or cancel any order, including orders that appear to be placed by dealers, resellers or distributors, and orders where the payment cannot be verified.
4. Orders and contract
Your order is an offer to buy the products in your cart. We accept your offer when we send the order confirmation email. If we cannot accept an order, for example because a product is unavailable or a payment fails, we let you know by email and refund any amount already charged. You can change or cancel an order until it has been handed to the carrier, as described in our Refund and Exchange Policy.
5. Shipping
Orders are shipped within the United States only. Processing time, cut-off, transit time and total delivery time are set out in our Shipping Policy, which forms part of these Terms. Risk of loss passes to you when the parcel is delivered to the address you provided. If a parcel is lost or damaged in transit, we handle it as described in the Shipping Policy.
6. Returns, exchanges and refunds
Returns, free size and color exchanges and refunds are governed by our Refund and Exchange Policy, which forms part of these Terms. In summary: returns are accepted within 30 calendar days of delivery for unworn, unwashed items with tags attached, exchanges for a different size or color are free and the replacement ships as soon as the exchange is registered, and refunds are issued to the original payment method within 5 business days of receiving the return.
7. Accuracy of information
You agree to provide current, complete and accurate purchase and account information for all purchases made on the Site, and to promptly update your email address, shipping address and payment details so that we can complete your transactions and contact you as needed. Occasionally there may be information on the Site that contains typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions or availability. We reserve the right to correct any errors and to update information or cancel orders if any information on the Site is inaccurate at any time without prior notice, including after you have submitted your order.
8. Intellectual property
The Site, its design, texts, images, logos and other content are owned by or licensed to Mumora Media LLC and are protected by copyright, trademark and other laws. You may not reproduce, distribute, modify or create derivative works from any part of the Site without our prior written permission, except for viewing and printing pages for your personal, non-commercial use.
9. Third-party links and tools
The Site may contain links to third-party websites or use third-party tools, such as our carrier's tracking pages and the order tracking application on the Site. We are not responsible for the content or accuracy of third-party websites and we do not warrant third-party tools. Any use of third-party websites or tools is at your own risk and subject to the terms of the relevant third party.
10. User comments and submissions
If you send us comments, suggestions, proposals or other materials, whether at our request or otherwise, you agree that we may use them without restriction and without any obligation to you, and that they do not violate the rights of any third party. We are under no obligation to maintain any comments in confidence or to respond to them. You are solely responsible for any comments you make and their accuracy.

Your submission of personal information through the Site is governed by our Privacy Policy, which explains what data we collect, why, and what rights you have.
12. Prohibited uses

We reserve the right to terminate your use of the Site for violating any of the prohibited uses.
13. Warranties and limitation of liability
We do not guarantee that your use of the Site will be uninterrupted, timely, secure or error-free. Except for the return, exchange, refund and defect commitments made in our Refund and Exchange Policy and Shipping Policy, and except for rights that cannot be excluded under applicable law, the products and the Site are provided "as is" and "as available", without any express or implied warranties of any kind, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. To the fullest extent permitted by law, Mumora Media LLC, its members, officers, employees, affiliates and suppliers are not liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Site or of any product purchased through it. Where liability cannot be excluded, it is limited to the amount you paid for the product concerned. Some states do not allow the exclusion or limitation of certain warranties or damages; in such states our liability is limited to the maximum extent permitted by law. Nothing in this section limits our obligations for defective goods under the Refund and Exchange Policy.
14. Indemnification
You agree to indemnify, defend and hold harmless Mumora Media LLC and its members, officers, employees, affiliates and suppliers from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.
15. Severability
If any provision of these Terms is found to be unlawful, void or unenforceable, that provision shall be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be deemed severed from these Terms. Such determination shall not affect the validity and enforceability of any other remaining provisions.
16. Termination
These Terms are effective unless and until terminated by either you or us. You may terminate these Terms at any time by ceasing to use the Site. If in our sole judgment you fail to comply with any term or provision of these Terms, we may terminate this agreement at any time without notice, and you will remain liable for all amounts due up to and including the date of termination.
17. Entire agreement
These Terms and the policies referenced in them constitute the entire agreement between you and us and govern your use of the Site, superseding any prior agreements. Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.
18. Governing law and disputes
These Terms and any separate agreements whereby we provide you products shall be governed by and construed in accordance with the laws of the State of Wyoming and the federal laws of the United States applicable therein, without regard to conflict of law principles. Any dispute that cannot be resolved informally shall be brought in the state or federal courts located in Wyoming, unless applicable consumer protection law in your state of residence gives you the right to bring a claim elsewhere. Before starting any formal proceedings, please contact us by email so that we can try to resolve the matter directly.
